Welcome to JOVIO. These Terms of Service ("Terms") govern your use of the JOVIO mobile application and related services (collectively, the "Service") operated by JOVIO ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using JOVIO, you agree to these Terms. If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

JOVIO is an AI-powered emotional wellness application that provides:

• Emotional check-in tools to help you identify and track your feelings
• AI-generated conversational support based on your emotional state
• Coping strategies, breathing exercises, and wellness tips
• A private space to process and reflect on your emotions

3. Eligibility

You must be at least 13 years old to use JOVIO. If you are under 18, you must have permission from a parent or guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to harm, threaten, or harass others
• Transmit any malicious code, viruses, or harmful content
• Use automated means to access the Service without permission
• Impersonate any person or entity

6.3 AI Limitations

JOVIO's AI companion is designed to be helpful and supportive, but it has limitations. The AI may occasionally provide responses that are not perfectly suited to your situation. Use your own judgment and seek professional help when needed.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by JOVIO and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8. User Content

Any content you provide through the Service (such as messages and emotional data) remains yours. However, by using the Service, you grant us a limited license to process this content to provide and improve the Service. We respect your privacy and handle your content according to our Privacy Policy.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may also delete your account at any time through the app settings.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOVIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless JOVIO and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
